Welcome to Auxth! These Terms and Conditions govern your use of our website (auxth.com), our AI Employee services and any related services or products offered by Auxth. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By subscribing to our Pro ($299/month), Advanced ($499/month), or Elite ($699/month) plans, creating an account, or otherwise engaging with our Services, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy. These Terms apply to all users, including individuals, businesses, or entities.

2. Services Provided

Auxth provides AI-powered services to enhance business operations, including:

Voice Agent AI: Automates inbound and outbound call handling.

Reviews AI: Manages online reviews across platforms.

Conversation AI: Engages customers via chat on websites and apps.

Content AI: Generates brand-aligned marketing content.

Workflow AI Assistant: Automates business processes and workflows.

Ask AI: Provides instant customer query responses.

Funnel AI: Optimizes sales funnels for conversions.

Services are delivered via our platform and are subject to availability, updates, or modifications at our discretion.

3. Subscription Plans and Payments

Plans: We offer three subscription tiers:

Pro ($299/month): Includes Voice Agent AI, Reviews AI, Conversation AI, and Ask AI.

Advanced ($499/month): Includes all Pro features plus Content AI and Workflow AI Assistant.

Elite ($699/month): Includes all Advanced features plus Funnel AI and priority support.

Billing: Subscriptions are billed monthly in advance. Payments are non-refundable except as outlined in Section 6.

Payment Methods: We accept major credit cards and other methods specified at checkout. You authorize us to charge your selected payment method for the chosen plan.

Price Changes: We may adjust pricing with 30 days’ notice via email or website announcement. Continued use after changes constitutes acceptance.

Late Payments: Overdue payments may result in service suspension until the account is current.

4. User Responsibilities

You agree to:

Provide accurate, current, and complete information during account creation and payment.

Use the Services in compliance with all applicable laws and regulations.

Not misuse the Services, including unauthorized access, reverse engineering, or use for illegal purposes.

Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized use.

Ensure your use of AI-generated content (e.g., from Content AI) complies with intellectual property laws.

5. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time via your account dashboard or by contacting [email protected]. Cancellation takes effect at the end of the current billing cycle.

Refunds: Subscriptions are non-refundable, except in cases of service failure due to our error, where a pro-rata refund may be issued at our discretion. Refund requests must be submitted within 14 days of the issue to [email protected].

Trial Periods: If offered, free trials are subject to these Terms. We may require payment details to begin a trial, with automatic billing unless canceled before the trial ends.

6. Intellectual Property

Auxth’s IP: All content, software, and materials provided through the Services (e.g., AI-generated content, platform code) are owned by Auxth or its licensors and protected by copyright, trademark, and other laws.

User Content: You retain ownership of content you provide (e.g., review responses, customer data). By submitting content, you grant Auxth a non-exclusive, worldwide, royalty-free license to use, store, and process it to deliver the Services.

Usage Restrictions: You may not copy, modify, distribute, or reverse-engineer any part of the Services without prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Auxth and its affiliates, officers, or employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for the Services in the preceding 12 months.

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted access. While we strive for accuracy, AI-generated outputs (e.g., Content AI, Reviews AI) may contain errors, and you are responsible for verifying their suitability.

9. Indemnification

You agree to indemnify and hold harmless Auxth, its affiliates, and employees from any claims, damages, or losses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

10. Termination

We may suspend or terminate your access to the Services if you violate these Terms, fail to make payments, or engage in unlawful activities. Upon termination, your account data may be deleted, and you must cease using the Services. Sections 7–12 survive termination.

11. Changes to These Terms

We may update these Terms to reflect changes in our Services or legal requirements. Updates will be posted on this page with a revised effective date. We’ll notify you of material changes via email or website notice. Continued use of the Services after changes constitutes acceptance.
